Purpose of This Document

This document sets out the legal disclaimers and notices that TrustTrace displays to users of the Platform. These notices appear: (a) on the homepage; (b) on every published Report page; (c) within the report submission flow; and (d) in user communications.

1. General Platform Disclaimer

TrustTrace is a community-powered fraud reporting registry. The information published on this Platform is submitted by members of the public and verified by TrustTrace against official references including SAPS case numbers and FSCA records. However:

TrustTrace does not guarantee the accuracy, completeness, or currency of any Report.

A listing on TrustTrace reflects an allegation that has passed our verification process. It does not constitute a criminal conviction, civil judgment, or regulatory finding.

Reports should not be used as the sole basis for any legal, financial, or personal decision.

TrustTrace is not a law enforcement agency and has no powers of investigation, arrest, or prosecution.

If you believe you have been defrauded, report the matter to SAPS (10111) and the FSCA (0800 110 443) in addition to filing a report with TrustTrace.

TrustTrace operates as a hosting service provider under the Electronic Communications and Transactions Act 25 of 2002. In accordance with Section 78 of ECTA, TrustTrace is not liable for unlawful content hosted on the Platform where TrustTrace:

Did not author, generate, or initiate the transmission of such content;

Did not select the recipient of such content;

Did not select or modify the information contained in such content; and

Upon obtaining actual knowledge that the content is unlawful, acts expeditiously to remove or disable access to that content.

To submit a takedown notice under ECTA Section 77, contact: legal@trusttrace.co.za with the subject line "ECTA Takedown Notice". Include: (a) your full name and contact details; (b) a description of the allegedly unlawful content and its URL; (c) a statement under oath that the information is accurate and that you are authorised to make this request.

6. Limitation of Liability

To the maximum extent permitted by South African law, TrustTrace shall not be liable for:

Any indirect, consequential, special, or punitive damages arising from use of the Platform;

Any damages arising from reliance on information published on the Platform;

Any damages arising from unauthorised access to or alteration of your transmissions or data;

Any conduct of third parties on the Platform.

TrustTrace's total liability to any user for any claim arising from or related to the Platform shall not exceed the amount paid by that user to TrustTrace in the 12 months preceding the claim, or R1,000 (one thousand Rand), whichever is greater.
